Application for a Non-Material Amendment to amend condition numbers 23 &
29 attached to decision notice PA12/10064 so that their wording and
requirements accord with directly related conditions 7 and 8 attached to
decision notice PA1 7/04182.


Land adjacent Asda, South Quay, Hayle, Cornwall TR27 4EP

As discussed in our preapplication meeting there Is currently discrepancy in the
wording and requirements of some of the conditions contained within the two related
decision notices for the next phase of development at South Quay. This application
seeks to resolve that discrepancy so that the issues and the approach for dealing
with them are common to both decision notices.

In this respect:

Condition 23

The extent of the proposed hard landscape works for the next phase of development
on South Quay has already been provided and approved under decision notices
PA17/ 04181 which dealt with the reserved matters application and PA1 7/04182
which was the full planning application for the Gatehouse. The works are shown on
approved drawing 1838/P/014 P2 which is common to both decision notices and
enclosed for reference.

Decision notice PA1 7/04182 also includes a condition 8 which requires final
confirmation of the details of the hard landscaping works, namely:

The hard landscape works shail be carried out tn accordance with the approved
details, that shall have been previously submitted to and approved tn writing by
the Local Planning Authority, prior to the occupation of any uni hereby permitted

 
 
and these works and notice shall be given to the Local Planning Authority when
the approved scheme has been completed.

The hard landscaping details shall include [case officer to delete as appropriate]:
- proposed finished ground levels or contours;
- means of enclosure;
- car parking layout
- other vehicle and pedestrian access and circulation areas;
- hard surfacing materials
- minor artefacts and structures (eg. furniture, refuse or other storage units,
signs, lighting etc.);

- proposed and existing functional services above and below ground (eg.
drainage, power, communications cables,
pipelines etc. indicating lines, manholes, supports etc.)

Reason: {n the interests of visual and residential amenity and in accordance with
the aims and intentions of paragraphs 7/ and 58 of the National Planning Policy
Framework 2012.


As both applications are now at the same development stage and reference a
common approved drawing it is proposed that Condition 23 of PA12/10064 be
amended to reflect Condition 8 of decision notice PA1 7/04182 as quoted above, with
a minor change to the reason so that it reflects the latest version of the NPPF as
suggested below.

Reason: [n the interests of visual and residential amenity and in accordance with
the aims and intentions of paragraph 127 of the National Planning Policy
Framework 2019.


Condition 29

Significant detail regarding the building and surface materials has previously been
submitted with the reserved matters and gatehouse applications (PA1 7/04171 and
PA17/04182 accordingly) and feature on the approved drawings of both applications.
In order to provide consistency in approach between the conditions attached to
decision notices we propose amending the wording of Condition 29 of decision
notice PA12/10064 so that it replicates the text of Condition 7 attached to decision
notice PA17/04182, namely:

No work on the external walls shall commence until details of the materials to be
used in the construction of the external surfaces (doors/windows/lintels/
sils/stonework/roof and methad of fixing) of the building hereby permitted have
been submitted fo and approved in writing by the Local Planning Authority. The
development shail be carried out in accordance with the approved details and
refained as such thereafter.


Reason: |n the interests of visual amenity and to protect the character of the

WHS and Conservation Area in accordance with the aims and intentions of
Paragraphs 72/7 of the National Planning Policy Framework 2079.
