HAYLE TOWN COUNCIL

COUNCIL MEETING THURSDAY 17 JANUARY 2019
Minutes of the Hayle Town Council Meeting held at the Hayle Community Centre, Hayle on
Thursday 17 January 2019 commencing at 7.15pm with a Public Participation Session.

7.15PM PUBLIC PARTICIPATION SESSION
John Bennett spoke regarding PA18/10457, Foundry Yard planning application and referred to
Dave Slatter’s rebuttal of his original objection (see Appendix B).
[7.20pm Councillor Channon joined meeting.]
There was a short discussion about the development’s benefits to the town, namely more
housing for residents.

7.27PM THE MEETING COMMENCED
181 CHAIRMAN’S ANNOUNCEMENTS (FOR INFORMATION ONLY)
It was announced that the Resource Committee meeting scheduled for 24 January had been
deferred until April 2019.
182 TO RECEIVE APOLOGIES
Apologies had been received from Councillor Wills.
183 TO RECEIVE DECLARATIONS OF INTEREST AND REQUESTS FOR
DISPENSATIONS
Councillors Coad and Pollard declared an interest in agenda item 8a (minute 188a refers) and
made the following statement: - ‘In commenting on these issues/applications I should make it
clear that my comments are based on the information currently available and do not commit
me to taking the same position if the matter is discussed at the Cornwall Council Planning
Committee and full information is available.’

Councillors Capper and Pollard declared an interest in PA18/10457 as trustees of Harvey’s
Foundry Trust and stated that they would make comments during the discussion but would not
take part in the vote.
184 TO APPROVE THE MINUTES OF FULL COUNCIL MEETING 3 JANUARY
2019
It was resolved
that the minutes of the full council meeting 3 January 2019 be taken as a true
and accurate record, the mayor signing each page before placing them in the record book.
185 TO DISCUSS MATTERS WHICH WERE RAISED DURING PUBLIC
PARTICIPATION 3 JANUARY 2019
No members of the public had wished to speak.
186 CONSULTATION: TO CONSIDER AND RESPOND TO THE DRAFT
CORNWALL COUNCIL (OFF STREET PARKING PLACES) ORDER 2019
Further to his report at the previous full council meeting Councillor Pollard reported that the
increase in tariffs at 3% was not negotiable, but the structure of tariffs was part of the
consultation. Members were interested in the introduction of reserved parking permits in many
car parks, which could make parking as low as £1 per day in some of them and if introduced
in Hayle could address problems with on street parking in the town which was at a premium.
There was a short discussion regarding the reduction of space for overnight parking of
motorhomes and some members thought it a retrograde step which did no service to tourism in
Cornwall.
It was resolved to respond to the consultation noting that the town council 1) does not dispute
the charges; 2) requests information regarding the different packages available to Hayle; and
3) asks for the justification for the extension of overnight motorhome prohibition as per
amendment 3 in the notice.
187 STANDING AGENDA ITEMS
a) Cornwall Community Governance Review
The clerk reported that on 4 January (the morning after the last full council meeting) she had
written to the generic community governance review email address, Matt Stokes and Vanessa
Luckwell, but had received no acknowledgment to date.
The email from Cornwall Councillor Sue Nicholas commenting on the deadline for responses
and hoping for an extension, which was so far not forthcoming, was noted.
It was resolved to respond to the original consultation by expressing an interest in having a
review for the parish of Hayle.
b) Hayle Neighbourhood Plan

It was noted that the Hayle Neighbourhood Plan was proving its use in considering planning
applications and thanks were offered to Councillor Rance and John Bennett for the hard work
which enabled them to cite the relevant parts.
c) Hayle Harbour Development
Regarding the North Quay planning application, the clerk reported that she had contacted
Joanne Cave to inform her that the reports she had forwarded were old reports and that it was
the more recent comments from ICOMOS and the WHS that had been requested by councillors.
There was some concern that there was already a problem with traffic queuing, and thereby
causing pollution, in the town before the North Quay development had been built. It was noted,
however, that there was a facility for traffic lights at Jubilee Bridge which would go live when
the development was in place, and members were informed that pollution monitoring in Hayle
had just gone/or was about to go live. Monitoring would last a year so any reports would not
be available until it was completed.
It was reported that the clerk had written a letter to all Cornwall Council (CC) Cabinet members
regarding CC’s change of focus from regeneration of the harbour to merely housing; she agreed
to copy the letter to all Hayle Town Council (HTC) councillors.
There followed a discussion regarding planning gain and S106 agreements. It was noted that
S106 agreements were attached to the planning permission and any developer using it was
bound by the agreements as benefits and liabilities were inherited when land changed hands.
Affordable housing was also discussed and members were reminded that CC had decided that
the provision of 17% affordable housing was required for the development as a whole, but that
it did not have to affect the first phase of the development and was included in the Riviere
Fields development phase.
It was resolved to write to Cornwall Council officer/s Jeannette Hurrell and/or Peter
Bainbridge to ask for current information regarding the S106 agreements relating to the North
Quay planning application.
188 PLANNING MATTERS

PA18/11927; PA18/11908; PA18/11893; PA18/08693; PA18/11832;
PA18/11753; PA18/11894 and PA19/00126
Councillors Capper and Pollard did not take part in the vote regarding PA18/10457.
For the resolutions on individual planning applications see Appendix A attached.
b) To note the results of previous applications
There were none.
189 FOOTPATHS
a) Maintenance update
There was nothing to report regarding footpaths.

Regarding the land slip onto King George V Memorial Walk, a meeting to explain the full
situation had been arranged for the following Monday at 1.30pm. Councillor Pollard would be
attending in his capacity as CC and HTC councillor; Mike Peters and possibly Jon Mitchell
and Richard Hocking would also be attending for CC. Councillors Polkinghorne and Benney
would also be attending, but unfortunately not Councillor Wills as she was away. The meeting
would not be a closed meeting if any other councillors wanted to attend, but it was noted that
it was important not to overwhelm the meeting with too many attendees.
The meeting closed at 8.50pm.
